Department Recommendation:
Staff recommends City Council authorize the City Manager to execute the amendment to the reimbursement agreement associated with the Burke Street storm basin master plan improvements.

Background Discussion:
On December 7, 2020, the City Council approved the authorization to execute the reimbursement agreement with San Joaquin Valley Homes (developer) for the reimbursement of additional offsite work directed by the City as an addendum to their original subdivision development (i.e., Reimer Subdivision which was part of the former K Avenue County Island). The addendum included offsite improvement plans for the excavation of a new regional new basin for the area, fencing, storm drain and sewer extensions, and new pavement on Burke Street and K Avenue (see attached Aerial Map). In addition to these items, a mechanical storm drain plug was noted as a requirement of the regional basin design but this portion of the basin improvement was still under design review by City staff and not included in the initial reimbursement agreement. Under the executed reimbursement agreement provisions, costs of improvements associated with the subdivision development were to be reimbursed at the time of completion of the sewer facilities.
