Department Recommendation:
Staff recommends adopting Resolution No. 2026-70 ordering the summary vacation and abandonment of a portion of right-of-way along Douglas Avenue west of Burke Street adjacent to Parcel 1 of Parcel Map 127 , recorded in Book 2 of Parcel Maps, at Page 27, Tulare County Records and further authorizing the City Manager to execute the necessary documents to complete the abandonment.

Summary:
The abandonment of the right-of-way is being requested by a representative for the owner due to an existing permanent structure located within a portion of existing right-of-way.

This vacation and abandonment is being conducted in accordance with California Streets and Highways Code Section 8334(a) allowing the vacation of an excess street or highway that is not required for street or highway purposes. The proposed vacation meets the provisions of this section allowing the use of a summary process.

Background Discussion:
The right-of-way was previously dedicated to the City for public roadway purposes.

An existing permanent structure is located within a portion of the dedicated right-of-way, creating an encroachment into the City's current roadway. The affected portion is not required for existing or reasonably foreseeable roadway purposes.
