Department Recommendation: Staff recommends that the City Council authorize the recordation of the final parcel map for Tentative Parcel Map No. 2024-11, subdividing 4.89 acres of R-1-5 Single-family Residential designation into 3 residential parcels east of the intersection of East Prospect Avenue and North Cain Street.
Summary:
Tentative Parcel Map No. 2024-11 is a request to subdivide a 4.89-acre parcel into three parcels measuring 4.38 acres, 0.36 acres, and 0.15 acres with the intent to construct single-family residences over each individual parcel. There is currently a proposed development for parcel 3 under the subdivision of Jenning Estates; however, there is an existing residence on parcel 1 and no proposed development for parcel 2.
Background Discussion:
Tentative Parcel Map 2024-11 is being recorded to establish three parcels. Parcel 3 has proposed the subdivision of Jenning Estates for the construction of single-family homes. An easement for ingress and egress will provide access to both parcels 1 and 2. With the improvement of parcel 3, frontage improvements such as sidewalk, parkway, drive approach, and extension of North Cain Street to its ultimate right-of-way.
The parcel map will also dedicate 5 feet of right of way for North Cain Street.
Pursuant to Title 16 (Subdivisions) of the Visalia Municipal Code, the City’s authorization to record the final parcel map is a ministerial action. Specifically, Section 16.24.080 limits the City Council’s action to the specific determination that the final parcel map conforms substantially to the contents of the tentative map, Chapter 16, and the Subdivision Map Act, and provides in pertinent part that “if the Council determines that the map is in conformity with the requirements of this Chapter, the Council shall approve the map (emphasis added).” Disapproval based upon any other reasons would be outside the authority of the Council for this particular action. The Council may reject any and all offers of dedication in the final parcel map pursuant to Section 16.24.080, and require that the City Engineer so indicate on the map, however staff’s recommendation is that the City Council authorize recordation of the final parcel map and accept all offers of dedication as previously described in this report.
Fiscal Impact: Impact fees will be assessed at the time of development of each residential parcel.
Prior Council Action: Tentative Parcel Map No. 2024-11 was approved by City of Visalia Planning Commission on February 24, 2025.
