Department Recommendation:
Staff recommends that the City Council approve Visalia Transit’s 2024 Title VI Program, adopt Resolution No. 2025-01, and authorize the City Manager to review, approve, and sign future updates to the Program.
Background Discussion:
Visalia Transit has updated its Title VI Program in compliance with United States Department of Transportation Title VI regulations, 49 Code of Federal Regulations (CFR) Part 21. The Federal Transit Administration (FTA) requires recipients to update and submit its FTA Title VI Program every three (3) years. The City’s Program was last updated and adopted by the City Council at its meeting on May 17, 2021.
Title VI is a federal statute and provides that "no person shall, on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefit of, or be subject to discrimination under any program or activity receiving federal financial assistance. Pursuant to FTA Circular 4702.1B - Title VI Guidelines, at a minimum, the document must address the following:
- Notify Beneficiaries of Protection under Title VI
- Develop Title VI Complaint Procedures and Compliant Form
- Record and Report Transit-Related Title VI Investigations, Complaints, and Lawsuits
- Promote Inclusive Public Participation
- Provide Meaningful Access to limited English Proficiency (LEP) Persons
- Minority Representation on Planning and Advisory Bodies
- Provide Additional Information upon Request
- Develop System-Wide Standards and Policies
The City is required to ensure its transit services are responsive to and compliant with Title VI regulations.
The FTA requires recipients to update and submit its FTA Title VI Program every three (3) years. The City’s last Title VI Program was approved in 2021. The Program was prepared by the Tulare County Association of Governments (TCAG), the Metropolitan Organization (MPO) for Tulare County.
The only changes and updates to this Program are related to route system changes and adjustment within Visalia Transit. Aside from those ongoing updates, there are no significant changes to the Plan from the adopted 2021 Program.
Fiscal Impact:
There is no fiscal impact from completing the Program.
Prior Council Action:
At its meeting on May 17, 2021, the City Council approved the 2021 Title VI Program for Visalia Transit and adopted Resolution No. 2021-21.
