Department Recommendation:
Staff recommends that the City Council authorize the recordation of the final parcel map for Tentative Parcel Map No. 2024-08, subdividing 148.09 acres of industrial and light industrial designated property into 4 parcels at the northeast corner of the intersection of North Kelsey Street and West Riggin Avenue.
Summary:
Tentative Parcel Map No. 2024-08 is a request to subdivide a 148.09-acre parcel into four parcels measuring 100.00 acres, 21.31 acres, 21.24 acres, and 5.54 acres with an industrial and light industrial designation. The project consists of the west 148.09 acres of the proposed 280 gross acre subdivision approved by planning commission on February 10, 2025. The parcel map will provide the city an irrevocable offer of dedication in fee for North Kelsey Street and North Clancy Street, a storm water easement along its entire frontage, and a pedestrian trail easement along the Modoc Ditch.
Background Discussion:
Tentative Parcel Map No. 2024-08 was previously approved to subdivide approximately 280 acres into multiple parcels. The proposed final parcel map represents the initial phase of the approved tentative map and will subdivide approximately 148.09 acres into four parcels. The remaining acreage included within the approved tentative parcel map will be subdivided under future parcel maps as development of the project continues.
The final parcel map includes several dedications and easements necessary to serve the subdivision and implement the approved development plan. An irrevocable offer of dedication is being offered for future public street right-of-way along Kelsey Street and Clancy Street. The map also establishes a storm water easement for the installation and maintenance of storm drainage facilities, a reciprocal access easement benefiting parcels 1 through 3 to provide shared access between the parcels, and a pedestrian trail easement across parcels 1 and 4 to accommodate future pedestrian circulation. These dedications and easements are consistent with the approved tentative parcel map and will facilitate future public infrastructure and coordinated development of the site.
Pursuant to Title 16 (Subdivisions) of the Visalia Municipal Code, the City’s authorization to record the final parcel map is a ministerial action. Specifically, Section 16.24.080 limits the City Council’s action to the specific determination that the final parcel map conforms substantially to the contents of the tentative map, Chapter 16, and the Subdivision Map Act, and provides in pertinent part that “if the Council determines that the map is in conformity with the requirements of this Chapter, the Council shall approve the map (emphasis added).” Disapproval based upon any other reasons would be outside the authority of the Council for this particular action. The Council may reject any and all offers of dedication in the final parcel map pursuant to Section 16.24.080, and require that the City Engineer so indicate on the map, however staff’s recommendation is that the City Council authorize recordation of the final parcel map and accept all offers of dedication as previously described in this report.
Fiscal Impact: Impact fees will be assessed at the time of development of each individual parcel.
