Department Recommendation:

Staff recommends Council adopt Resolution No. 2022-41 to designate various road projects for Road Maintenance and Rehabilitation Account (RMRA) 2022/23 funding from the State of California Road Repair and Accountability Act of 2017 (Senate Bill SB1) to the following Capital Improvement Project’s (CIP’s):

1.                     $750,450 -Downtown Pavement Rehabilitation

2.                     $1,719,550 -Caldwell Avenue Improvements from Akers to Shady

3.                     $613,000 -Center & Acequia Rehabilitation

 

This agenda item is being brought forth because the SB1 Program requires a resolution that details the projects that will be funded with that fiscal year allotment of SB1 funds.  This money is being appropriated with the FY 22/23 Budget adoption in the SB1 Fund (113).

 

Background Discussion:

In April 2017, the Governor signed Senate Bill (SB) 1, known as the Road Repair and Accountability Act of 2017 to address basic road maintenance, rehabilitation, and critical safety needs in the State. This bill established a new funding source for road repairs through revenue established from per-gallon excise taxes on gasoline and diesel fuel, and vehicle registration fees. The Act provides inflationary adjustments to tax rates in future rates. Funding from this Act is forecasted to disburse approximately $3,086,000 in Fiscal Year 2022/23 to the City of Visalia.

 

SB1 emphasizes the importance of accountability and transparency in the delivery of California’s transportation programs. Therefore, cities and counties receiving the funding will be required to provide annual RMRA project information to the California Transportation Commission (CTC). This includes action by City Council at a regular public meeting to adopt a list of projects proposed to be funded with RMRA funds for each fiscal year. The project list must be submitted to the CTC by July 1st in order to receive and not delay the apportionment of RMRA funds for the upcoming fiscal year. The report of the anticipated use of funding shall include a description of the project including location, estimated project schedule and expected useful life.

 

In addition, for each fiscal year in which the City spends RMRA funds, the City must submit a report to the CTC that details the RMRA funds expended to include a description and location of each completed project and/or in-progress project, the amount of funds expended on the project and the completion date. The CTC posts reported project information on the Commission’s website and through other reporting mechanisms that are accessible by the public.

 

In order to receive funding for fiscal year 2022/23, Council must adopt by resolution a list of projects intended to utilize the fiscal year 2022/23 SB1 RMRA funding and submit to the California Transportation (CTC) by July 1, 2022.

 

Staff recommends Council designate the projects listed below, as listed on the attached resolution, for RMRA 2022/23 funding. It is important to note that these projects were previously approved by Council to receive SB1 RMRA funding. But due to forecasted increases in the cost of construction, staff recommends that these funds be designated as additional appropriation(s) towards these projects:

 

Project 1) Project Title:  Downtown Pavement Rehabilitation

 

Project Description/Scope: This project will rehabilitate Main Street and will include construction of pavement rehabilitation, limited sidewalk repairs and curb ramps, and ADA-compliant parking stalls. 

 

SB1 funds from prior fiscal years were approved to fund engineering and construction of the Downtown Pavement Rehabilitation Project. At the Council meeting held on April 4, 2022, Council approved additional SB1 funds from the future fiscal year 2022-23 in the amount of $750,450 be designated to the Downtown Pavement Rehabilitation project to address a construction budget shortfall for a total amount of $3,520,800 using SB1 funds. Although, Council previously approved the use of fiscal year 2022-23 funds, adoption of the attached resolution that lists this project to utilize fiscal year 2022-23 SB1 funds is required by the CTC.

Project 2) Project Title:  Caldwell Avenue Improvements from Akers to Shady

 

Project Description/Scope: This project will reconstruct existing pavement; add median islands, sidewalk, curb, gutter, bicycle lane striping, fiberoptic conduit, and streetlights.

 

SB1 funds will be utilized to fund the construction phase. This project was previously approved by Council at the meeting on April 15, 2019  to receive SB1 RMRA funds from the fiscal year 2019/21 allotment in the amount of $2.2 million. The additional appropriation of SB1 RMRA funds of $1,719,550 will bring the total of SB1 RMRA funds budgeted toward this project to $3,919,550.

Project 3) Project Title:  SB1 Street Rehabilitation - Center & Acequia

 

Project Description/Scope: The purpose of this project is to rehabilitate the pavement surface of segments along both Center Avenue and Acequia Avenue. In addition to rehabilitation work, the project will include limited concrete repairs to curbs, gutters, sidewalks, drain inlets, and ramps. Impacted ramps will be upgraded to ADA compliance.  The project will also include installation of video detection cameras.

 

SB1 funds will be utilized to fund engineering and construction for both street segments. This project was previously approved by Council at the meeting on June 21, 2021 to receive SB1 RMRA funds from the fiscal year 2021-22 allotment in the amount of $2.6 million. This additional appropriation of SB1 RMRA funds of $613,000 will bring the total of SB1 RMRA funds allocated toward this project to $3,213,000.

Fiscal Impact:

SB1 RMRA funding in fiscal year 2022/23 of approximately $3,083,000 is projected to be distributed to the City of Visalia based on the State Department of Finance projections of RMRA revenues as of May 2022.

Revenues received for RMRA funds are appropriated to CP0290 Pavement Rehabilitation within the SB1 RMRA Fund (113); however, CP0290 does not specify a project location. Therefore, upon approval of the list of projects to utilize FY 2022/23 RMRA funds, funds will be transferred from CP0290 Pavement Rehabilitation to the following projects:

 

1.                     $750,450 -Downtown Pavement Rehabilitation

2.                     $1,719,550 -Caldwell Avenue Improvements from Akers to Shady

3.                     $613,000 -Center & Acequia Rehabilitation

 

If funding is received in excess of the current projected estimated amount, staff will return to Council at a future date to request an appropriation of funds to a specific project as necessary.

Adopted Resolution 2021-34 to designate 2021/22 SB1 RMRA funding to the FY 2021-22 SB1 Street Rehabilitation - Center & Acequia Project.

 

April 4, 2022

Approved additional SB1 funds be appropriated to the Downtown Pavement Rehabilitation Project (CP0373).
