Department Recommendation:
Staff recommends that the City Council adopt Resolution 2022-33 a resolution authorizing the City Manager to execute Southern California Edison (SCE) Utility Agreement No. CP0473-SCE2592 for the Transmission Pole(s) relocation along Riggin Avenue between Mooney Blvd and Conyer St to accommodate the Riggin Widening Project. The agreement was prepared by the City of Visalia in coordination with Caltrans, SCE, and reviewed and approved by the City Attorney.
Background Discussion:
The Council, at their June 21st, 2021, meeting directed staff to award the design contract to 4Creeks Inc. and accepted and appropriated $2.4 million from the Federal High Improvement Program (HIP) funds for the construction of the “Riggin Avenue Widening Project” from North Mooney Boulevard to North Conyer Street.
The purpose of the “Riggin Avenue Widening Project” is to increase vehicle capacity on Riggin Avenue by adding additional east/west lanes and to provide for an efficient flow of traffic in support of the increase in development within the surrounding area. In addition, the City Council identified this segment of Riggin Avenue from Mooney Boulevard to North Conyer Street as a priority transportation corridor as it was part of the “Ring-Road” concept previously identified in various City reports.
The City of Visalia acceptance of the $2.4 million from Highway Infrastructure Program (HIP) federal funding for the construction of the “Riggin Avenue Widening Project” is contingent on finalizing the environmental phase, right-of-way certification, and construction design package which is currently on scheduled for submission in June 2022.
Before any roadway construction can begin, the SCE transmission poles will need to be relocated to their ultimate location on the future north edge of the ultimate roadway. This Utility agreement needs to be executed to complete the ROW certification process and formalize the cost liability between SCE and the City of Visalia.
This utility agreement is necessary to identify the financial liability for the relocation of the SCE transmission poles; to outline who is responsible for the work and to set expectations in finalizing the relocation. The agreement clauses are per Caltrans standard language and is required as part of the ROW certification process. This will be the only Utility Agreement necessary for this project as other utility conflicts will be moved per franchise agreement and there will be no cost splitting of liability.
Based on liability research and historical records, it has been determined that SCE is financially responsible for eight (8) out of the ten (10) poles that need to be relocated. The two (2) poles that are the City’s responsibility are part of an existing Joint Utility Agreement while the remaining eight poles are to be covered by the franchise agreement.
Project Status
The project is currently at 90% design and in review. California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) environmental phase has been completed and utility relocation efforts are ongoing. Submittal for “Request for Authorization” to formally obligate construction funds is due July 1st 2022 and is anticipated to be submitted ahead of that date. Utility relocation and underground work is anticipated to begin Fall of 2022 with road construction starting Summer of 2023. Staff will return to Council to review the frontage road design and public outreach plans.

The projected deficit will be resolved at the time of award of the construction contract. There are anticipated savings on utility relocation costs on the Riggin Widening Kelsey to Shirk project which can cover the current budget deficit. The agreement allows the City to coordinate with SCE for utility relocation efforts. The cost of utility relocation will be determined upon completion of relocation plans.
