Department Recommendation: Staff recommends that the City Council approve a contract with Porterville Asphalt and Martin Marietta Materials for the supply of cold mix asphalt. The contract with the low bidder, Porterville Asphalt, shall not exceed $623,000 annually, totaling $3,115,000 over the term of the contract. The contract with the second lowest bidder, Martin Marietta Materials, shall not exceed $200,000 annually, totaling $1,000,000 over the term of the contract. Both contracts include an option to renew annually for up to (4) additional one-year terms.

 

Summary:

Approval of the proposed contracts will allow the City to procure cold mix asphalt material on an as-needed basis for ongoing street maintenance operations, including pothole repair, overlays, and pavement rehabilitation projects. Staff recommends awarding contracts to both Porterville Asphalt and Martin Marietta Materials to ensure material availability and operational continuity. The City will utilize the lowest responsive bidder as the primary supplier and may procure material from the secondary supplier when material availability, plant outages, scheduling, or operational needs require.

 

Background Discussion:

Within the City’s 40-square mile jurisdiction, the Street Maintenance division maintains approximately 534 miles of streets. Maintaining the streets is done with several different procedures, including, but not limited to, thin skin patches, minor overlays, dig outs, and pothole patching. These procedures all utilize either hot or cold mix asphalt material.

 

The City of Visalia Purchasing Division solicited bid proposals through Request for Bid (RFB) 24-25-56 for an annual contract for the supply of cold mix asphalt material on an as needed basis. Purchasing advertised the RFB on April 8th, 10th & 15th,2026 in the Visalia Times Delta, on Bid Net, and sent letters to companies the City has worked with in the past. Bids were publicly opened on May 14, 2026, and received the following 2 bids:

 

1. Porterville Asphalt - $89 per ton

2. Martin Marietta Materials - $110 per ton

 

However, as stated in the RFB the city would be using a True Delivered Cost (TDC) calculation.

 

Bidders provided a unit price per ton for the supply of cold mix asphalt for use by the Streets Division.

 

The City calculated a True Delivered Cost (TDC) per ton for award using a standardized hauling cost factor and the one-way distance from the asphalt plant to the City’s designated delivery point. For bidding purposes, the delivery address was the City of Visalia’s Corporation Yard, 336 N. Ben Maddox Way, Visalia, CA.

 

To ensure the overall best value to the City, the award was to be based on the lowest True Delivered Cost per ton, provided the bidders meets all technical, operational, and regulatory requirements of the RFB.

 

The calculated True Delivered Costs are as follows:

 

1. Porterville Asphalt - $97.10 per ton

2. Martin Marietta Materials - $112.18 per ton

 

Staff recommends awarding contracts to both responsive bidders to maintain flexibility and ensure uninterrupted access to cold mix asphalt material. The City intends to utilize the lowest responsive bidder whenever possible, however, having a secondary supplier available allows staff to respond to material shortages, plant shutdowns, emergency repairs, and scheduling constraints that may arise during street maintenance operations.

 

Staff evaluated the bids received and determined that both firms meet the requirements of the RFB.

 

Porterville Asphalt also held the City’s previous contracts for the supply of Cold Mix Asphalt and has satisfactorily provided services during the prior contract terms.

 

Approval of these contracts will provide continuity of service and maintain established coordination with City staff and street operations.

 

Historical expenditures for the supply of cold mix asphalt are as follows:

FY23-24 = $155,202

FY24-25 = $313,115

FY25-26 = $444,332

 

Fiscal Impact including annual maintenance and operating costs:

Funding for the material purchases under these contracts are available in the various Street Maintenance Capital Improvement Projects budgeted in the Gas Tax Fund as follows:

                     CP9515 Annual Pothole Patching

                     CP9520 Annual Thin Skin Patching

 

Prior Council Action: On September 16, 2024 City Council authorized a contract with Jaxon Enterprises (dba Deer Creek Asphalt) by piggybacking on County of Tulare contracts.
