Department Recommendation:

Staff recommends that the City Council adopt Resolution 2026-63, designating City owned property located at the southeast corner of Caldwell Avenue and Ben Maddox Way into the public right of way system

 

Summary:

In March 2024, the City acquired property at the southeast corner of Ben Maddox Way and Caldwell Avenue for a temporary storm drain basin and future street right-of-way associated with the Caldwell Avenue Widening Project. With the project nearing substantial completion, a portion of the completed street improvements is located on City-owned property that must now be formally incorporated into the City’s public right-of-way system.

 

Background Discussion:

On March 21, 2024, Document No. 24-0012939 was recorded in connection with the Caldwell Avenue Widening Project. The document granted a portion of the property located on the southeast corner of Caldwell Avenue and Ben Maddox Way to the City of Visalia for use as a temporary on-site storm drain basin and, ultimately, portions to be dedicated as public right-of-way for street improvements.

 

The Caldwell Widening project is nearing substantial completion. However, portions of the improvements along Caldwell Avenue and Ben Maddox Way extend onto City-owned property that has not yet been formally incorporated into the City’s public right-of-way system. 

 

Fiscal Impact including annual maintenance and operating costs:

The approval of this agenda item has no fiscal impact; the area being converted to right of way is owned by the City of Visalia.

 

Prior Council Action:

October 7, 2024: City Council accepted an update on the real property negotiations for properties needed for the Caldwell Avenue Widening from Santa Fe Street to Lovers Lane Project (CP8268).

April 1, 2024: City Council accepted an update on the real property negotiations for the properties needed for the Caldwell Avenue Widening from Santa Fe Street to Lovers Lane Project (CP8268). 

December 18, 2023: City Council accepted an update on the real property negotiations for the properties need for the Caldwell Avenue Widening from Santa Fe Street to Lovers Lane Project (CP8268). 

September 18, 2023: City Council accepted an update on the real property negotiations for properties needed for the Caldwell Avenue Widening from Santa Fe Street to Lover Lane Project (CP8268)  

June 5, 2023: City Council accepted an update on the real property negotiations for properties needed for the Caldwell Avenue Widening from Santa Fe Street to Lovers Lane Project (CP8268). 

November 21, 2022: Council, in closed session, approved property appraisals and authorized City staff and consultant to purchase properties with authority to pay up to twenty percent above appraised value.

Environmental Assessment Status:  The environmental assessment has been completed.

 

CEQA Review:  The CEQA review was conducted by the County of Tulare for the Avenue 280 (Caldwell Avenue) Corridor Enhancement project.
