Department Recommendation:
Staff recommends that the City Council adopt Resolutions 2022-39 and 2022-40, designating a portion of City owned property located within 2 parcels of two different subdivisions; Lot “A” of Highland Park Estates subdivision and Lot “A” of Highland Park, Unit No. 2 subdivision as part of the public City street system respectively in order to meet the federal requirements to utilize federal funding.
Background Discussion:
The Council, at their June 21st, 2021, meeting directed staff to award the design contract to 4Creeks Inc. and accepted and appropriated $2.4 million from the Federal High Improvement Program (HIP) funds for the construction of the “Riggin Avenue Widening Project” from North Mooney Boulevard to North Conyer Street.
The purpose of the “Riggin Avenue Widening Project” is to increase vehicle capacity on Riggin Avenue by adding additional east/west lanes and to provide for an efficient flow of traffic in support of the increase in development within the surrounding area. In addition, the City Council identified this segment of Riggin Avenue from Mooney Boulevard to North Conyer Street as a priority transportation corridor as it was part of the “Ring-Road” concept previously identified in various City reports.
The City of Visalia acceptance of the $2.4 million from Highway Infrastructure Program (HIP) federal funding for the construction of the “Riggin Avenue Widening Project” is contingent on finalizing the environmental phase, right-of-way certification, and construction design package which is currently on scheduled for submission in June 2022 ahead of the July 1st deadline.
Before any roadway construction can begin, the SCE transmission poles will need to be relocated to their ultimate location on the future north edge of the roadway.
In order to relocate the Southern California Edison (SCE) transmission poles, a granting of an easement to SCE is typically required to establish for the “swing and rise” and pole anchor space needed for the new transmission pole locations. As such, an easement would need to be granted to SCE to complete the Right of Way (ROW) certification ahead the July 1st deadline. However, a grant of easement is a lengthy process that requires two ordinance readings followed by a 30-day waiting period to be effective.
Because of the grant funding deadline, time is of the essence for establishing the means for relocation. Therefore, an alternative and faster approach is recommended, which is to convert the pole relocation area necessary into public ROW or in other words, the City Street System. The specific pole relocation locations were developed by SCE and based on their infrastructure requirements and coordinated with the City for mutual acceptance. Both of these parcels as shown in the attached exhibits are within the subdivision’s L&L’s landscape boundary. These parcels have been dedicated in fee to the City to be used for landscaping, public utilities, sidewalks, block walls, or for other public purposes but it is not within the public ROW. The proposed process will transfer these parcels into the public ROW, which is a public purpose that this property can be used for under the stated dedication terms. This will allow the poles to be relocated under the City’s franchise agreement, no easements would be necessary, and would significantly streamline the ROW certification timeline for the funding to construct our project.

City staff has reached out to the other parcel owners, as they are privately owned, to coordinate ROW dedication or grant of easements for SCE use to facilitate the power relocation.
