Department Recommendation:

Staff recommends that the City Council authorize the City Engineer to file a Notice of Completion for the Grading of Peoples Basin contract with Wood Bros., Inc. 

 

Background Discussion:

The Peoples Basin is part of the Lower Kaweah River and Mill Creek System Flood Control Improvements Project.  Three basins make up this project which will reduce flood risk to the City of Visalia.  The other two basins are the Oakes Basin and Goshen Basin.  All three basins are being increased in capacity to reduce peak floodwater flows in the Kaweah River and Mill Creek.  The project adds other benefits such as groundwater recharge capacity and native plant and animal habitat.

 

The Peoples Basin is located on the Lower Kaweah River about 10 miles northeast of Visalia.  The closest cross streets are Avenue 322 and Road 204.  The basin grading was completed by this contract.  A second project associated with the Peoples Basin will be advertised next summer to build the inlet and outlet structures, install electrical service and pump, and landscape the project according to grant requirements. 

 

Final cost for the basin earthwork was $874,750.00.  The original construction contract was $865,120.00.  Total change order costs were $9,630.00 or 1.11%.  A breakdown of the contract changes follows:

The single change order was requested by city staff to clear a pathway on the Road 204 right-of-way to the future entry to the basin site.  Staff also requested that debris be removed from the existing pond.  The debris included old tires, concrete, steel standpipe, power pole, and meter box that were in the existing pond and were part of an abandoned irrigation system.  The debris was hidden by overgrowth in the pond. 

 

Fiscal Impact:

The Lower Kaweah River and Mill Creek Flood Control Project is multi-funded with State Proposition 1E and local matching funds from the Storm Sewer Deficiency Fund (222).  The following table is a breakdown of the overall project budget:

Estimated Project Budget Shortfall

The above table reflects the budget summary for Goshen and Peoples Basins.  The Oakes Basin (CP0515) was taken out from the original group and is now a standalone project due to the receipt of a California Natural Resources, Prop. 68 grant.   The budget shortfall indicated above does not affect the Notice of Completion (NOC) for the Grading of Peoples Basin.  The Grading of Peoples Basin was completed below the original engineer’s estimate. 

 

There are two remaining construction projects under the Prop 1E Grant Fund:  1) The Goshen Basin Project which is currently under construction, and 2) The Peoples Structures and Landscape Project which is planned for construction in the next fiscal year.  Additional funds are projected to be needed to complete the Peoples Structures and Landscape Project.  Engineering staff will work with the City Finance Department to resolve the projected budget shortfall needed to complete the grant mandated work.  Additional funds may be needed from the Storm Sewer Deficiency (Fund 222).

 

The bid received back in September for the Peoples Structures and Landscape Project exceeded the engineer’s estimate and caused a shortfall in the overall project budget.  Staff believes that the reasons for the overage are twofold:  1) The original Proposition 1E grant funds were sunsetting and the construction time was squeezed to complete the work in time, and 2) Construction phases that started after spring 2022 are experiencing price inflation and material shortages due to manufacturing and shipping delays. 

 

Since then, the city received notice that Proposition 1E funding has been extended by the state legislature.  Staff believes that rebidding the Peoples Structures and Landscape Project with a longer construction schedule may result in lower bids. 

 

 

Prior Council Action:

June 06, 2022

Authorize the City Manager to award the construction contract for RFB 21-22-47, Goshen Basin Project, to JT2 dba Todd Companies in the amount of $1,957,000

 

February 22, 2022

Appropriate California Natural Resource Agency (CNRA), Proposition 68 - Urban Flood Protection Grant funds and transfer Storm Sewer Deficiency (222) funds from Lower Kaweah River and Mill Creek Flood Control Project to the Oakes Basin. 

 

December 20, 2021

Authorized the City Manager to award the construction contract for RFB 21-22-20, Grading of Peoples Basin to Wood Bros. Inc. in the amount of $865,120.

 

December 21, 2020

Authorized the City Manager to award the construction contract for RFB 20-21-21, Site Demolition and Clearing of the Oakes Basin in the amount of $178,760.

Environmental Assessment Status:

Environmental assessment is complete.  A mitigated negative declaration was completed for the CEQA document.  Cultural Resources and Biological studies were done as part of CEQA compliance process.  Mitigation measures are stipulated in the CEQA findings.
