Department Recommendation:

Staff recommends that the annexation public hearing item be withdrawn from the City Council agenda. The annexation, along with an appeal of Elliott Tentative Subdivision Map No. 5597, which was filed on August 21, 2024, has been noticed for the September 16, 2024, City Council meeting.

Summary:

The Planning Commission conducted public hearings on July 22, 2024, and August 12, 2024, for Annexation No. 2024-01 and Elliott Tentative Subdivision Map No. 5597, together a request by San Joaquin Valley Homes (SJVH) for the annexation of 59.13-acres into the Visalia City Limits for development of a 225 single-family residential subdivision. The Planning Commission approved the subdivision request and recommended approval of the annexation to the Visalia City Council.

Staff noticed the annexation in the Visalia Times Delta newspaper for a public hearing before the City Council on September 3, 2024. The public hearing notice was published in the newspaper on Thursday, August 22, 2024.

However, on August 21, 2024, the City Clerk received an appeal of the Planning Commission’s approval for the Elliott Tentative Subdivision Map No. 5597. Due to the appeal filing, the annexation item should not be heard by the City Council at this time. The public hearing for the annexation and appeal of the tentative subdivision map has been noticed for the September 16th City Council meeting.

Fiscal Impact: Not applicable at this time.
