Department Recommendation:
Staff recommends that the Visalia City Council Authorize the City Manager to enter into an agreement with the Department of Toxic Substance Control (DTSC) for oversight and review of assessment and remediation services listed in Exhibit C of the agreement in the amount of $32,211. Staff is also recommending to appropriate $40,000 from the Convention Center Fund for the costs associated with the agreement and to cover miscellaneous cost that are associated with this project.
Background Discussion:
Prior the mid to late 1980’s Willow Avenue was through street connecting Bridge Street and Court Street, where the City of Visalia Convention Center is currently located. In this time period and prior the land within this area was configured amongst various individual parcel of which the City the did not have ownership. This area is located in the block bound by Acequia Avenue to the north, Bridge Street to east, Mineral King Avenue to the south, and Court Street to the west. Within the various parcels not owned by the City a dry cleaning facility operated pre-1970’s.
The City of Visalia began the process of acquiring the various parcels within this block from the mid 1970’s through the late 1980’s. This would lead to the construction and establishment of the City of Visalia Convention Center and facilities in its current location.
In the early 2000’s the Department of Toxic Control Substances (DTSC) detected traces of tetrachlorethylene (PCE) in the Visalia area and began evaluating current and past dry cleaning facility locations in order to ensure mitigation assessments and measures of any possible contaminations resulting from operations of these facilities. Due to the Convention Center located on a parcel with historical connection to a dry cleaning facility prior to City of Visalia ownership of the parcel, the DTSC at this time would like City of Visalia to enter into a standard voluntary agreement for oversight and review of assessment and remediation services.
Fiscal Impact:
City staff recommends the City enter into an agreement with the Department of Toxic Substance Control in the amount of $32,211 for assessment and remediation services. In addition, staff recommends to appropriate $40,000 from the Convention Center Fund for the costs associated with the agreement and to cover miscellaneous cost that are associated with this project.
Should anything materialize from the efforts identified with in this agreement between the City and DTSC, Staff will return to City Council for direction, approval and additional appropriation if needed.
