Department Recommendation:  Staff recommends that the City Council authorize the filing of the Notice of Completion for the Valley Strong Stadium (Recreation Park) Expansion & Remodel of Clubhouse & Batting Cage: Task 1 - Batting Cage & Related Site Work.

Summary:

Task 1 - Batting Cage & Related Site Work expanded & replaced the existing batting cage/pitching tunnel and replaced it with a 5,804 SF pitching facility. The new batting cage/pitching facility includes a 4,200 SF tunnel, with the remaining space allocated with a weight room, equipment storage room, and team storage room (MLB club). The improvements were constructed to comply with Minor League Baseball/Major League (MiLB/MLB) requirements. Construction of task 1 was part of the design build agreement with 4CGlobal, Inc. dba 4Creeks Build in the amount of $1,867,198.84 with the final cost for task 1 totaling $1,895,570.89. This notice of completion is for task 1 only, city staff anticipates coming back to council for completion of Task 2 - Clubhouse & Related Site Work in April 2026.

Background Discussion:

In 2021, Ewing Cole prepared an audit report of the ballpark which graded the facilities to determine if they are in compliance with MiLB/MLB requirements. Several features around the park received grades less than the standard cutoff, including the clubhouse and batting cage. On October 7, 2024 the City Council authorized the City Manager to execute a professional services agreement with 4Creeks, Inc., as a sole-source provider, for the design of the expansion and remodel of the clubhouse at the Valley Strong Stadium in the amount of $420,000; to procure limited construction materials through 4Creeks during the design phase in an amount up to $1,100,000; and to appropriate $4,342,028 from the baseball fund.

On February 3, 2025, the City Council authorized the City Manager to execute an emergency Progressive Design-Build Agreement (PDBA) with 4CGlobal, Inc. dba 4Creeks Build, Inc. Subsequently, as required by the PDBA, 4CGlobal presented the City with a proposed cost of $1,867,198.84 for Phase 2, Task 1 - Batting Cage & Related Site Work, which was accepted by the City Council at the March 3, 2025, meeting. This accepted construction proposal demolished the existing batting cage/pitching tunnel and replaced it with a 5,804 SF pitching facility. The new batting cage/pitching facility includes a 4,200 SF tunnel, with the remaining space allocated for a weight room, equipment storage room, and team storage room (MLB club). The improvements were constructed to comply with Minor League Baseball/Major League (MiLB/MLB) requirements.

There were three (3) construction change orders processed for the project, resulting in a total construction cost of $1,895,570.89. The total construction change orders amounted to $28,372.05 (1.51%). The following is a breakdown of the construction change orders.

Owner Directed Change in Scope (CoS):

As discussed in the August 4, 2025 City Council staff report, the owner directed change in scope incorporated the procurement of two (2) turf pitching mounds to be used in the pitching tunnel of the batting cage. These pitching mounds will be in use with the other items like turf and netting that were included in the furniture, fixtures, and equipment (FF&E) items that were agreed upon.

Unforeseen Conditions (UN):

The change in scope due to unforeseen conditions included removing and rerouting an existing 6” fire hydrant line and an additional 4” domestic line that were found during excavation for the building pad. The 4” water line was later found to be the line that provided water to the existing clubhouse building. The contractor rerouted both lines around the permitter of the new building and installed a needed shutoff valve to continue to provide water to the new building and clubhouse. Another unforeseen change order that came in as cost credit was for striping paint inside the batting cage. With the addition of turf and netting inside the facility a cost credit was given by the contractor as the turf would cover where the lines were to be painted.

Errors & Omissions (E & O):

The change in scope due to errors & omissions includes the cost of adding rock and splash pads to the east side of the new batting cage facility. During design of the batting cage down spouts, the drafter assumed water from the roof of the batting cage building would simply drain into the dirt area behind the building. As observed after construction, this drainage was causing erosion around the footings and slab of the batting cage building. This change order covers the cost to add rock and splash pads under the downspouts to stop the erosion.

As discussed in the August 4, 2025 City Council staff report, there are additional FPE requested items that were included in the project for the facility to meet MiLB/MLB requirements.  These items are not included in the 4CG construction total for the batting cage. These requested items include batting cage netting and turf. Staff has included the cost for the furniture, fixtures, and equipment (FF&Es) in the updated budget shown below and processed the netting and turf from the construction contingency line item shown in the table below. In accordance with the August 4, 2025 Council approval, staff and FPE met and agreed on the maintenance and replacement responsibilities for all of the FFE items. A separate side letter agreement prepared by the City Attorney’s office is processing and is to be signed by all parties prior to occupancy of the clubhouse.

Fiscal Impact:  The total budget for completion of the Valley Strong Stadium (Recreation Park) Expansion & Remodel of Clubhouse & Batting Cage: Task 1 - Batting Cage & Related Site Work and Task 2 - Clubhouse & Related Site Work is $5,976,052 from the Baseball Fund which is subsidized by the General Fund.

Included in this budget is the contract amount awarded to 4C Global, Inc., contingency, FF&E, items and support costs such as professional design services and materials testing services. The budget is further broken down in Table 1 below. This is one of three projects covered under the agreement that was executed in 2024 between the City of Visalia and First Pitch Entertainment, LLC. That agreement covered projects related to upgrading the sports lighting to LED (completed in 2025); the outfield wall/padding/batter’s eye (recently completed); and the clubhouse/batting cage (this project). An overall budget update of these three projects is shown below in Table 2.
