Department Recommendation:

Staff recommends City Council authorize the City Manager to execute the amendment to the reimbursement agreement associated with the Burke Street storm basin master plan improvements.

 

Background Discussion:

On December 7, 2020, the City Council approved the authorization to execute the reimbursement agreement with San Joaquin Valley Homes (developer) for the reimbursement of additional offsite work directed by the City as an addendum to their original subdivision development (i.e., Reimer Subdivision which was part of the former K Avenue County Island). The addendum included offsite improvement plans for the excavation of a new regional new basin for the area, fencing, storm drain and sewer extensions, and new pavement on Burke Street and K Avenue (see attached Aerial Map). In addition to these items, a mechanical storm drain plug was noted as a requirement of the regional basin design but this portion of the basin improvement  was still under design review by City staff and not included in the initial reimbursement agreement. Under the executed reimbursement agreement provisions, costs of improvements associated with the subdivision development were to be reimbursed at the time of completion of the sewer facilities. The sewer improvements have been completed and monies have been reimbursed to the developer for the sewer improvements. However, reimbursement of the storm improvements are still pending because reimbursement would not be made until completion of these improvements which included the mechanical storm drain plug that was still under design review.

San Joaquin Valley Homes has completed the mechanical storm drain plug design and has filed an amendment to the reimbursement agreement. The amendment to the agreement now includes the final costs and reimbursement provisions of the mechanical storm drain plug installation in the amount of $167,202.00. Please note, the installation of the mechanical storm drain plug work is considered supplemental and outside typical developer responsibilities; therefore, the City’s reimbursement program qualifies this work for full compensation once this equipment is installed. Reimbursement for the remaining storm drain costs identified in the original agreement will continue under the existing stipulations.

On October 13, 2021, the Development Reimbursement Review Committee (DRRC) reviewed the storm drain mechanical plug costs. The DRRC is comprised of staff from Community Development, Public Works, and Finance Departments. The DRRC reviewed the reimbursement amounts to ensure that the costs are reasonable compared to the City’s costs for comparable capital projects and to a unit cost schedule focused on Visalia’s construction market. The DRRC recommend approval to the City Council that the cost for the storm drain mechanical plug is reasonable.

 

Fiscal Impact:

Cash reimbursement from the Storm Sewer Fund (CP9229) in the amount of $167,202.00.

 

Prior Council Action:

                     On June 5, 2017, the City Council adopted Negative Declaration No. 2017-17 and initiated the filing of Annexation No. 2017-01 (Reimer Subdivision) to LAFCO.

                     On August 6, 2018, the City Council authorized the recordation of the final map for Reimer Subdivision.

                     On September 16, 2019, the City Council authorized the filing of a Notice of Completion for Reimer Subdivision.

                     On December 7, 2019, the City Council authorized the purchase of three acres of land for $110,000 per acre for a future regional storm drainage basin and appropriated and additional $27,300 for closing costs and staff time from the Storm Sewer Construction Fund.

                     On December 7, 2020, the City Council authorized the City Manager to execute the reimbursement agreement associated with the Burke Street storm basin master pan improvements, located on Burke Street between Monte Vista and K Avenues.

 

Other:

                     On April 24, 2017, the Planning Commission approved tentative subdivision map for Reimer Subdivision.

                     On November 18, 2020, the DRRC reviewed and recommended approval of the reimbursement agreement for the Burke Street basin offsite improvements.

                     On October 13, 2021, the DRRC reviewed and recommended for approval the amendment to the agreement for the storm drain mechanical plug costs.
