Department Recommendation:
It is recommended that the City Council approve the second reading of Ordinance 2024-01, authorizing the City Manager to enter into a 10-year agreement with Dr. Christopher J. Wood, DDS, MS, for the use of 4 parking spaces at Mayor’s Park during the hours of 8 am - 5 pm, Monday - Friday, in exchange for the upkeep and maintenance of the parking lot and immediate surrounding landscaping.
Background Discussion:
In 1984, Dr. Stephen McAuliff rehabilitated a building at 1549 West Main Street as an orthodontic office. In order to provide adequate parking for his patients, he approached the City about constructing 4 parking spaces on the edge of Mayor’s Park. The Council, at that time, granted a ten-year agreement with the option to renew it for an additional ten years. Dr. McAuliff renewed the lease in 1994, and at the time of the renewal, another ten-year option was added, extending the lease until 2004.
In 2004, Dr. McAuliff reached out to continue the agreement keeping the terms of the agreement the same, which allowed his office the use of the spaces from 8 am to 5 pm, Monday through Friday and he is solely responsible for the cost of all upkeep and maintenance of the parking spaces and surrounding landscaping. Council agreed to adopt Ordinance 2004-24, granting him a new agreement for ten years with an option for an additional ten years.
In November of this year, the City received a letter from Dr. McAuliff notifying us that he had sold the business and the property to Dr. Christopher Wood, DDS, MS. Staff reached out to Dr. Wood to see if he was interested in the same general agreement that Dr. McAuliff had maintained for the last 40 years and he was very eager to continue the relationship with the City that Dr. McAuliff had established. He understands that all maintenance, paving, striping, landscaping, and insurance costs are solely his responsibility in exchange for his office’s use of the 4 parking spaces from 8 am - 5 pm, Monday through Friday.
Article VI, Section 16 of the City Charter requires any lease made for a period of longer than five years be approved by an ordinance. Ordinance 2024-01, authorizing the execution of the attached Parking Agreement is attached for introduction. A second reading will be held at the next regular Council meeting.
