Department Recommendation:

Staff recommends that the City Council:

1.                     The City Council authorize the City Manager to execute the SCE Utility Agreement No. CP0398-SCE2490; and

2.                     Adopt Resolution 2024-46 for the transmission pole and distribution pole relocation agreement along Riggin Avenue between Kelsey St to Shirk St.

Background Discussion:

The Riggin Avenue widening project, from Kelsey Street to Shirk Street, is preparing to go out to bid for construction to start in the fall of 2024.  The project will increase vehicle capacity on Riggin Avenue by adding additional lanes and to provide for an efficient flow of traffic to support growing industrial development within the surrounding area. The City Council identified this segment of Riggin Avenue as a priority transportation corridor and to advance its construction through the use Measure R Regional Bond Funds at the December 3, 2019 City Council Work Session meeting.

Before any roadway construction can begin the Southern California Edison (SCE) Transmission and Distribution poles in conflict with the project will need to be relocated to their ultimate location.  This relocation agreement needs to be executed in order to mobilize SCE crews to relocate the facilities.

Based on liability research, historical records and agreement with SCE,it has been determined that SCE is 100% financially responsible for the relocation of eighteen (18) distribution poles along Riggin Avenue and 50% responsible for the undergrounding of two (2) distribution poles immediately north and west of the northwest corner of Riggin Ave and Shirk St intersection.  The City is 100% financially responsible for the relocation of five (5) transmission poles, and 50% financially responsible for the undergrounding of two (2) distribution poles immediately north and west of the northwest corner of Riggin Ave and Shirk St intersection. Currently the total cost to the City after considering the various cost sharing components is $1,081,000.

This project is partially funded through the U.S. Economic Development Administration (EDA). EDA has awarded the City of Visalia $4,000,000 to help supplement funding needed for this project. TIF funds were also approved towards this project to make up the difference of the total amount of funds needed to complete the project.

As Council is aware, the industrial park is experiencing rapid growth.  Expansion of this goods movement and transportation corridor will help to mitigate traffic congestion issues along the major northern arterial connecting northern Visalia with Highway 99. There are many economic diversification opportunities in this corridor, particularly with the amount of speculative industrial development activity occurring. Growing these industrial job opportunities will generate more ‘primary jobs’ for the Visalia community and the greater region. In economic development terms, primary jobs are jobs that produce goods and/or services for customers that are predominantly outside the community. This creates new "outside" dollars for circulation in the local economy. Once a primary employer is paid for the products and/or services, they redistribute that wealth in the local community through wages paid to employees and through suppliers.

The proposed project will support the mission of the EDA by providing workforce development opportunities and enhancing the manufacturing capacities of regions.

Environmental Assessment Status:

Environmental review of the project, including the pole relocation has been completed.  The pole relocation is part of the Riggin Avenue Widening, Kelsey to Shirk Project which was reviewed under the California Environmental Quality Act (“CEQA”) see Mitigated Negative Declaration No. 2021-62, previously adopted by the Visalia City Council, this included a review of the road widening and pole relocation. The adopted mitigation measures will apply during pole relocation. The project was also considered under the National Environmental Policy Act (“NEPA”) since it involves the expenditure of federal grant funds. The project, including pole relocation, falls under a categorical exclusion to NEPA, and therefore no further review under NEPA was required.
