Department Recommendation:
Staff recommends that City Council authorize the filing of a Notice of Completion for Highland Park, Unit No. 1 subdivision.
Summary:
All the required improvements for this subdivision have been completed and are ready for acceptance by the City Engineer. Highland Park, Unit No. 1 subdivision was developed by Woodside Homes and contains 76 single-family residential lots.
The developer has submitted a maintenance bond in the amount of $215,420.53 as required by the Subdivision Map Act, to guarantee the improvements against defects for one year. Staff recommends that authorization be given to file the Notice of Completion.
Background Discussion:
City Council authorized the recording of the final map for Highland Park, Unit No. 1 subdivision on June 21, 2021. All bonds and cash payments, as identified in the subdivision agreement, were received by the City at that time. As required by the subdivision ordinance, a maintenance bond valued at 10% of the cost of the public improvements has been submitted prior to recording of the Notice of Completion. The Maintenance Bond is held for one year after the recording and acts as a warranty for the public improvements installed per the subdivision agreement.
Fiscal Impact:
By authorizing this Notice of Completion, the City of Visalia will incorporate the identified public improvements into normal routine maintenance plans and procedures following the one-year maintenance period. This will have a nominal adverse effect on the fund that provides such maintenance.
Prior Council Action:
• On June 21, 2021, the City Council authorized the recordation of the final map for Highland Park, Unit No. 1 subdivision.
• On February 7, 2022, the City Council authorized the formation and assessment of Landscape and Lighting Assessment District No. 21-04.
Other:
• On May 26, 2020, Finding of Consistency No. 2020-001 was approved by the Planning Commission allowing minor modifications to the public street design and phasing of the tentative subdivision map.
• On August 26, 2013, Conditional Use Permit (CUP) No. 2012-27 was approved by the Planning Commission to amend previously approved CUP No. 2006-03; revising development standards and dwelling types of the previously approved PUD in the RM2 zone.
• On February 27, 2006, the Highland Park at Shannon Ranch Tentative Subdivision Map No. 5509 and associated CUP No. 2006-03 were approved by the Planning Commission.
