Department Recommendation:
Adopt Resolution No. 2025-58 authorizing the acceptance of a portion of the Irrevocable Offer of Dedication to the City of Visalia for additional street right-of-way as offered under Parcel Map No.5260 for Riggin Avenue and Parcel Map No. 4452 for Clancy Street.
Summary:
Parcel Map No. 5260 provided a 13-foot Irrevocable Offer of Dedication (IOD) for the southerly portion of Riggin Avenue, west of Clancy Street, along Parcels 1 and 2 of the aforementioned parcel map to secure the future ultimate right-of-way limits for the arterial roadway. Exhibit ‘A’ attached to this report is the legal area being accepted at this time.
Parcel Map No. 4452 provided an IOD for the westerly portion of Clancy Street along the easterly boundary of the map to secure the future right-of-way limits of the minor collector street. The IOD begins at 43 feet in width at the northerly limits of the Remainder lot and expands to 60 feet in width at the southerly limits of the remainder lot. That portion is now being accepted with the accompanying resolution. Additionally, Parcel Map No. 4452 provided an IOD extending further south across Parcel 4 of the map, that portion will be dedicated by a separate map being processed at this time. Exhibit ‘B’ attached to this report is the legal area being accepted at this time.
Irrevocable Offers of Dedications are typically provided to the City when a parcel develops and a future road improvement is necessary. In lieu of dedicating the areas as street right of way, which would require regular City maintenance and liability, the IOD is offered for future acceptance as right of way, typically prior to full street improvements being constructed. The City is now ready to accept these portions of the IOD as detailed in Exhibit “A” and “B”. An adjacent development project has completed improvements on Clancy Street and construction will continue to complete the street widening along Riggin Avenue with the recent award of a City CIP project.
Background Discussion:
In 2019 an Irrevocable Offer of Dedication (IOD) under document number 2019-0048929, Tulare County Records, was offered for dedication along the southerly portion of the future public right-of-way for Riggin Avenue (Parcel Map No. 5260). As is standard procedure, the IOD was rejected and remained an IOD until such time as a resolution was passed accepting the area into the City’s right of way system.
In 2000 an IOD under document number 2000-0038766, Tulare County Records, dedicated the westerly portion of the future public right-of-way for Clancy Street (Parcel Map No. 4452) from Riggin Avenue to Sunnyview Avenue. As is standard procedure, the IOD was rejected and remained an IOD until such time as a resolution was passed accepting the area into the City’s right of way system.
The improvements along Riggin Avenue and Clancy Street were required under Site Plan Review No. 21-150 with the industrial development of Parcel 2 of Parcel Map 5260. The improvements to Riggin Avenue and Clancy Street have been constructed under Building Permit No. B220014 and a portion of the IOD is ready to be accepted by the City. The acceptance of street right of way includes approximately 660 lineal feet of Riggin Avenue and 1221 lineal feet of Clancy Street (reference IOD aerial exhibit attached).
Fiscal Impact: Incorporation of the identified public improvements into normal routine maintenance plans and procedures by the Public Works Department will have a nominal adverse effect on the fund that provides such maintenance.
