Department Recommendation:

Staff recommends authorizing the City Manager to execute the reimbursement agreement in the amount of $198,813.04 for improvements constructed along Demaree Street and Chinowth St, associated with the Caldwell & Demaree Garden Unit subdivision.                                                                         

 

Background Discussion:

The Caldwell & Demaree Garden Unit Subdivision, developed by San Joaquin Valley Homes, involved the subdivision of 19.03 acres into 91 residential lots and the completion of frontage improvements along Demaree Street and Chinowth Street. All required improvements for this subdivision have been completed and accepted by the City.

As per the Subdivision Improvement Agreement, arterial and collector roadway improvements were required along the project street frontages. Chinowth Street is identified as a funded collector in the City’s Circulation Element and Transportation Impact Fee program. Consequently, portions of the required public improvements along Chinowth Street are eligible for reimbursement under the City’s impact fee programs.

Additionally, the development required traffic signal improvements at the intersection of Packwood Ave and Demaree St to allow for a fully functioning intersection. The installation of this signal and associated improvements are also reimbursable by the City.

 

The total amount to be reimbursed to the developer is $198,813.04 for the excess in pavement, right-of-way dedication, traffic signal installation, and other miscellaneous work beyond the developer’s responsibilities.  Impact fees were paid by the developer for each residential building permit issued within the development: therefore, credits were not applied at the time of building permit issuance. Reimbursement would be due in the form of a cash payment to the developer of the off-site improvements.


On August 8, 2024, the reimbursement agreement for the Caldwell & Demaree Garden Unit Subdivision was reviewed and recommended for approval by the Development Reimbursement Review Committee (DRRC). The DRRC is comprised of staff from the Community Development and Finance Departments. The DRRC reviewed the reimbursement to ensure that the costs are reasonable compared to the City’s costs for comparable capital projects.

 

 

Fiscal Impact:

Cash reimbursement of $198,813.04 will be from the Transportation Impact Fee Fund (241).
