Department Recommendation:
Staff recommends that the City Council adopt Revised Resolution Nos. 2026-47 and 2026-48, upholding an appeal by removing the condition(s) requiring the frontage improvements along the designated remainder’s public street frontage for the Clements Ranch Tentative Subdivision Map No. 5606 and Tentative Parcel Map No. 2025-13, in response to the action taken by City Council following a public hearing on July 20, 2026.
Summary:
On July 20, 2026, the City Council considered an appeal of the Planning Commission’s conditional approval of Clements Ranch Tentative Subdivision Map No. 5606, Tentative Parcel Map No. 2025-13 and Conditional Use Permit No. 2025-24 related to the conditions for frontage improvements along the designated remainder’s public street frontage and sidewalk requirements within the gated private street subdivision. After receiving the staff report, staff’s presentation, consideration of the appeal request, and public comment, the City Council voted 5-0 to uphold the appeal and remove the Planning Commission’s adopted condition to impose Lovers Lane frontage improvements along the designated remainder. However, the City Council voted 3-2 to uphold the Planning Commission’s decision to require the construction of sidewalk(s) within the gated private street residential development. Based on the decision to remove the Lovers Lane frontage improvement condition along the designated remainder for both the subdivision map and parcel map, revised resolutions have been prepared for formal adoption reflecting the decision of the City Council on July 20, 2026.
Background Discussion:
The applicant, DR Horton, filed Clements Ranch Tentative Subdivision Map No. 5606, Tentative Parcel Map No. 2025-13, and Conditional Use Permit No. 2025-24, requesting to subdivide parcels totaling ±78.11 acres into 292 lots for single-family residential uses and additional out lots for private streets, utilities, landscaping, lighting, trails, and parks, to be located within the proposed R-1, R-M-2, and QP zones. The application was heard by the Planning Commission at a public hearing on June 8, 2026, and was conditionally approved to construct Lovers Lane frontage improvements in front of the designated remainder and to construct sidewalks within the private gated residential portion of the overall residential development.
A timely appeal was filed, and the appeal was heard at a duly noticed City Council hearing on July 20, 2026. The appeal of Clements Ranch Tentative Subdivision Map No. 5606, Tentative Parcel Map No. 2025-13, and Conditional Use Permit No. 2025-24, was heard. The City Council upheld the appeal and removed the conditions requiring Lovers Lane frontage improvements in front of the designated remainder as required per the Clements Ranch Tentative Subdivision Map No. 5606, and Tentative Parcel Map No. 2025-13. The appeal requesting removal of the condition requiring the construction of sidewalks within the gated private street development for Conditional Use Permit No. 2025-24 was heard and denied. No revised resolution is necessary for Conditional Use Permit No. 2025-24.
Fiscal Impact:
The project will not result in any fiscal impact to the City.
Prior Council Action:
On July 20, 2026, the City Council held a public hearing to consider an appeal of the Planning Commission’s conditional approval of Clements Ranch Tentative Subdivision Map No. 5606, Tentative Parcel Map No. 2025-13, and Conditional Use Permit No. 2025-24. The appeal of Clements Ranch Tentative Subdivision Map No. 5606 and Tentative Parcel Map No. 2025-13 was upheld by a vote of 5-0. The appeal of Conditional Use Permit No. 2025-24 was denied by a vote of 3-2.
