Department Recommendation:

Staff recommends that the City Council continue the public hearing item from the November 18, 2024, agenda to the December 3, 2024, meeting. Staff will re-notice the item for the December 3, 2024, City Council Meeting.

 

Summary

On October 14, 2024, the Visalia Planning Commission approved Conditional Use Permit No. 2024-17, a request to establish a fuel dispensing service station and car wash within the Commons at Visalia Parkway Shopping Center, at the southwest corner of West Visalia Parkway and South Mooney Boulevard. Following approval of the request, two appeals were filed on October 24, 2024, requesting the City Council review and rescind the approval given by the Planning Commission. Per Visalia Municipal Code requirements, the appeal public hearing date was scheduled for November 18, 2024.

On November 5, 2024, staff received correspondence from Jim Shehadey, the property owner and project proponent, requesting the Visalia City Council continue the public hearing for Conditional Use Permit No. 2024-17 to the meeting of December 3, 2024, to provide additional time for him and his consultants to review and provide responses to the two appeals filed. Staff supports the applicant’s request for continuation of the public hearing to December 3, 2024, as the appeals total 65 pages in length and contain numerous claims that require substantial research and response.

A legal public hearing notice was noticed in the local newspaper for the November 18, 2024, meeting prior to the applicant submitting their letter requesting the appeal be heard on December 3rd. As noted above, staff will notice the item for the December 3rd, 2024, City Council meeting.
