Department Recommendation:

Staff recommends authorizing the City Manager to execute the reimbursement agreement with Presidio JJR Greystone ll 63, LL (Developer) in the amount of  $275,139.04 for improvements constructed along Akers Street and dedications to riparian setbacks associated with the Greystone Phase 3 subdivision.                                 

 

Background Discussion:

The final map for the Greystone Phase 3 Subdivision involves the subdivision of a 19.11-acre site into 63 single-family lots, along with five outlots (A through E). These outlots are designated for purposes such as street frontage landscaping, a pocket park, and a section of the Modoc Ditch Trail.

 

As part of the Subdivision Improvement Agreement, arterial roadway improvements were required along the project frontage. Akers Street is identified as a funded arterial in the City's Circulation Element and Transportation Impact Fee Program. Consequently, portions of the required improvements along Akers Street are eligible for reimbursement under the City’s impact fee program.

 

Additionally, the development required land dedication along the Modoc Ditch Channel for trail purposes and riparian setbacks. This area dedicated is eligible for reimbursement under the Waterways Acquisitions Fund program.

 

The total amount to be reimbursed to the developer is $275,139.04 for excess pavement, right-of-way dedication along Akers Street, and the riparian setback dedication along the Modoc Ditch. Impact fees were paid by the developer for each residential building permit issued within the development, so no credits were applied at the time of building permit issuance. The reimbursement will be made as a cash payment to the developer for the work and dedication associated with Greystone Phase 3.

On December 11, 2024, the reimbursement agreement for the Greystone Phase 3 Subdivision was reviewed and recommended for approval by the Development Reimbursement Review Committee (DRRC). The DRRC, which is composed of staff from the Community Development and Finance Departments, reviewed the reimbursement to ensure that the costs are reasonable in comparison to the City’s costs for similar capital projects.

 

Fiscal Impact:

A cash reimbursement totaling $275,139.04 will be made to the Developer as follows:

Transportation Impact Fee Fund (241):
                     $176,539.04

 

Waterway Acquisitions Fund (261):                     $  98,600.00

 

Prior Council Action:
Council accepted the final map for the Greystone Phase 3 subdivision at their meeting held on November 1, 2021.

Council accepted the Notice of Completion for the Greystone Phase 3 subdivision at their meeting held on November 15, 2022
