Department Recommendation:

Staff recommends that the City Council adopt Resolution 2022-XX a resolution authorizing the City Manager to execute Union Pacific Railroad Company (UPRC) Reimbursement Agreement for preliminary engineering services necessary for the design of Goshen Trail Reconstruction Project.  The agreement was prepared by Union Pacific Railroad Company and reviewed and approved by the City Attorney.

 

Background Discussion:

City Council, at the May 2nd 2022 meeting, approved the award of the design contract to 4Creeks Inc. in the amount not to exceed $1,269,306 to prepare Plans, Specifications, Estimates and to coordinate with the Railroad in the development of construction documents for the Goshen Trail Reconstruction Project.

 

The Goshen Reconstruction project will require the installation of curb & gutter, reconstruction of existing asphalt multi use trail, intersection improvements, pedestrian signal modifications, trail lighting, bench installation and landscaping along the entire stretch of the trail.

 

As much of these improvements will have a direct or indirect impact on the adjacent railroad with specific operation implications at the various intersections, significant coordination with the UPRC is necessary to design the project.  Refer to attached Concept Design for intersection crossings and project proximity to the existing railroad.

 

As part of the initial coordination efforts with the UPRC, a reimbursement agreement is required to receive design review and design approval from the UPRC as required at the various intersection crossings as well as at other locations along the entire length of trail. 

 

UPRC estimated that major intersections may cost $10K in design review while minor intersections are closer to $5K.  This project will impact six (6) major intersections and seven (7) minor intersections; based on the estimates this would be a total of $95K in design review.  A reimbursement agreement of $100K was deemed appropriate to work through the design phase.

 

The scope of UPRC reimbursement agreement includes:

-                     Field Diagnostic(s) and inspections

-                     Plan, Specification, and Construction Review

-                     Project Design

-                     Preparation of project estimate for force account or other work performed by the railroad

-                     Meetings and travel

 

The UPRC will contact the California Public Utility Commission (CPUC) once 15% concept plans have been received; a field diagnostic meeting will then be schedule with UPRC, CPUC and the City to continue with the design phase of the project. Coordination between the CPUC and UPRC will continue through design completion and final approval.

 

Following the completion of the design, a Construction and Maintenance agreement will be executed with the Railroad ahead of the construction phase for the project. This agreement will stipulate construction costs, agency responsibilities and maintenance requirements.

 

A similar construction and maintenance agreement was executed with San Joaquin Valley Railroad Company (SJVRR) for the Oak Street extension; where in the SJVRR provided a scope and fee for design and construction services and then periodically invoiced the City for services rendered.

 

 

Project Status:

The Goshen Trail Reconstruction project is currently in design with the consultant working on environmental requirements, concept design level plans, and utility coordination. 

 

On June 15th, 2022 the City of Visalia submitted the Active Transportation Program (ATP) grant application Cycle 6 requesting state funding for the construction of the Goshen Trail Reconstruction project.

 

The final project cost was estimated at $22,884,112; the application requested $18M from the ATP state funding and the remaining $4.9M will be covered using local Measure R Trail funds.  We anticipate grant award announcement to be received in October 2022.

 

 

 

 

 

Fiscal Impact:

The design and ROW phase of this project is funded by Measure R Trails approved by voters and administered and programmed for funding by Tulare County Association of Governments (TCAG).

There are sufficient funds available in the project budget to fund the estimated amount of services to be provided by the Union Pacific Railroad Company, therefore no additional appropriations are needed at this time. 

 

Contingent upon receiving award of ATP grant funds Cycle 6, staff will return to Council to request authorization of the final grant award amount and additional Measure R Trail funds needed to complete construction.
