Department Recommendation:

Staff recommends that City Council authorize the filing of a Notice of Completion for Diamond Oaks - Unit No. 1 subdivision.                                                  

 

Background Discussion:

City Council authorized the recording of the final map for Diamond Oaks- Unit No. 1 subdivision on August 5, 2019. All bonds and cash payments, as identified in the subdivision agreement, were received by the City at that time.

All of the required improvements for this subdivision have been completed and are ready for acceptance by the City Engineer. As required by the subdivision ordinance, a maintenance bond valued at 10% of the cost of the public improvements has been submitted, in the amount of $255,065.41, prior to recording of the Notice of Completion as required by the Subdivision Map Act. This is to guarantee the improvements against defects for one year. The Maintenance Bond is held for one year after the recording and acts as a warranty for the public improvements installed per the subdivision agreement.

Staff recommends that authorization be given to file the Notice of Completion.

 

Fiscal Impact:

By authorizing this Notice of Completion, the City of Visalia will incorporate the identified public improvements into normal routine maintenance plans and procedures following the one-year maintenance period.  This will have a nominal adverse effect on the fund that provides such maintenance.

 

Prior Council Action:

                     On August 05, 2019, the City Council authorized the recordation of the final map for Diamond Oaks - Unit No. 1 subdivision.

                     On August 05, 2019, the City Council authorized the formation and assessment of Landscape and Lighting Assessment District No. 19-05.

                     On August 01, 2011, Council authorized revisions to the Pre-Annexation Agreement for Annexation No. 2004-11 relieving the property owner from developing this property in accordance to the Southeast Area Plan (SEAP).

                     On October 04, 2004, Council authorized the request to initiate annexation procedures for the property south of Caldwell Avenue between Burke Street and Ben Maddox Way, through Annexation No. 2004-11.

                     On June 10, 1987, Council authorized the use of landscape maintenance assessment districts per the Landscape and Lighting Act of 1972 for maintaining common area features that are a special benefit and enhance subdivisions.

 

Other:

                     On September 23, 2013, the Planning Commission approved the Diamand Oaks Tentative Subdivision Map No. 5547.

Mitigated Negative Declaration (MND) No. 2013-59 was prepared consistent with the California Environmental Quality Act and City of Visalia Environmental Guidelines adopted September 23rd, 2013.
