Department Recommendation:
Staff recommends that City Council authorize the recordation of the final map for Victory Oaks Phase 2 subdivision, located on the north side of Ferguson Avenue approximately 800 feet west of Demaree Street (44 Lots), and recommends authorizing the City Manager to execute the reimbursement agreement in the amount of $299,128.79 for Lot C of the Victory Oaks Phase 1 final map, a 1.99-acre parcel dedicated to the City for park development, located at the northwest corner of the subdivision.
Background Discussion:
The Final map for Victory Oaks Phase 2 Subdivision will subdivide 9-acre parcel into a 44-lots for residential development, this is the second and final phase for the tentative subdivision map (TSM 5586) Victory Oaks. Public right of way improvements, including the center median, along Ferguson Avenue were installed by the first phase of Victory Oaks. Victory Oaks Phase 2 will install internal local road improvements within the subdivision boundary.
The final map is ready for recording, all bonds, cash payments, subdivision agreement, and final map have been submitted by the developer, VoV Capital LP, A California Limited Partnership, as follows: 1) An executed subdivision agreement; 2) Faithful Performance Bond in the amount of $1,601,451.20, a Labor and Materials Bond in the amount of $800,725;, a Maintenance Bond in the amount of $160,145.12; 3) cash payment of $125,448.10 distributed to various accounts to cover City fees; and 4) final map. All required items have been submitted and approved by the City prior to the final map being executed and recorded.
The Landscape and Lighting Assessment District No. 24-04 was previously reviewed and approved as to form by the Landscape and Lighting District Committee. All new landscaping installed with this development will strictly adhere to the State Model Water Efficient Landscape Ordinance (MWELO).
Reimbursement Agreement for Park Lot
Victory Oaks Phase 1 final map dedicated Lot C, an 86,867 SF (appx. 1.99ac) lot to the City for a future neighborhood park. The City Parks and Recreation Department had prepared to acquire the land by map dedication and then design and build a neighborhood park by creating a Capital Improvement Project (CIP) for neighborhood park under Capital Project No. 0425 (CP0425). CP0425 consists of 3-5-acre neighborhood park to include walking paths, playground, picnic area, and open turf. Funding for land acquisition is to begin in fiscal year 2025-2026.
The reimbursement total for Victory Oaks Phase 1 Lot C is $299,128.79 for the acquired land, as based upon a City-wide land value appraisal report prepared annually. There will be credit provided to Victory Oaks Phase 2 for park acquisition impact fees in the amount of $83,072.00. The cash reimbursement amount due to the developer would be $216,056.79 to be paid in fiscal year 25-26 and after a Notice of Completion for the project has been recorded
The City’s Development Reimbursement Committee (DRRC) reviewed and recommended approval of the estimated reimbursement associated with the VOV CAPITAL LP, A California Limited Partner (Victory Oaks Phase 1- Lot C) subdivision in a meeting held on September 18th, 2024. Therefore, staff recommends the City Council authorize the City Manager to execute the agreement.
Fiscal Impact:
The 44 lots within Victory Oaks Phase 2 final map will start contributing to the landscape and lighting assessment district (L&LD 24-04) created with Victory Oaks Phase 1 final map for maintenance of common features related to this subdivision. The annual lot assessment will be $669.73 per lot.
Prior Council Action: On June 10, 1987 Council authorized the use of landscape maintenance assessment districts per the Landscape and Lighting Act of 1972 for maintaining common area features that are a special benefit and enhance subdivisions. On June 06, 2024, Council authorized recordation of the final map for Victory Oaks Phase 1 and the formation of the Landscape and Lighting Assessment District 24-04 “Victory Oaks” covering both phase 1 and 2 of the Victory Oaks development.
Other: The tentative subdivision map for Victory Oaks (Tentative Subdivision Map No. 5586) was approved by the Planning Commission on September 26th, 2022. Annexation No. 2022-01 for Victory Oaks was approved by the Planning Commission on September 26th, 2022, based on the findings and conditions in Resolution No. 2022.04. Development Reimbursement Review Committee (DRRC) approved park acquisition reimbursement of $299,128.79 on September 18th, 2024.
